This matter was between a major supplier of metal cutting equipment (the Defendant) and a purchaser (the Plaintiff).

The Plaintiff claimed that the equipment did not meet the specification supplied by the Defendant, e.g. the finish of the final product coming of the machine was not of the quality the Defendant had been led to believe the machine was capable of, or would be considered acceptable by the Plaintiffs customers.

ExITS provided expert witness input on behalf of the Plaintiff as part of a product liability claim.

The Defendant claimed that the machine did provide the quality required and that the Plaintiff had modified the machine.

The matter went to Court where it was established that the Defendant had not provided a machine that was capable of providing the quality that was specified or could reasonably be expected.

The Court found in favour of the Plaintiff, including all cost.
